VILLA RENTAL TERMS AND CONDITIONS PARTIES AND PURPOSE
This contract is made between the party renting the villa (hereinafter referred to as the 'customer') and the party renting out the villa (hereinafter referred to as 'Muses Kalkan') for a predetermined period between the start and end dates. Any customer who makes a reservation for one of the villas listed on the Muses Kalkan website via the website, by phone, or by email, along with their accompanying guests, is deemed to have accepted the terms below in advance. Any violation of these terms grants Muses Kalkan the right to unilaterally cancel the reservation, request the customer to vacate the villa, and withhold the deposit and rental fee.
RESERVATION AND PAYMENT
Pre-reservations for our villas can be made through the reservation form on our website, by phone, or by email. Once your reservation request has been received by Muses Kalkan, you will receive a confirmation via email, SMS, or phone call stating the total amount in GBP, EURO, USD, or TL. The villa will be reserved under your name and held for 2 (two) business days for distant dates and 1 (one) business day for close dates to allow time for the deposit payment. The required deposit amount and our bank account details will be sent to you via email, SMS, or phone call once villa availability is confirmed. If the deposit is not received within 2 (two) business days for distant dates and 1 (one) business day for close dates via bank transfer, EFT, or credit card payment, Muses Kalkan reserves the right to cancel the pre-reservation without informing the customer and accept other reservations for the villa. To finalize your villa reservation, a deposit of up to 35% of the total rental fee must be paid, with the remaining balance and the damage deposit (specified on the villa features page) to be paid in cash to Muses Kalkan on the check-in day. Entry to the villa is not permitted until the 'Villa Rental Agreement' is mutually signed, and the remaining balance and damage deposit are fully paid in cash. To prevent inconvenience, customers are strongly advised to have the required amounts ready in cash on the day of check-in.
PRICING
The rental rates listed on our website are per night. The deposit can be paid via bank transfer, EFT, or credit card payment.
CANCELLATION POLICY AND REFUNDS
If a reservation is canceled up to 30 days before the check-in date, the full deposit amount will be refunded. If the cancellation occurs within 30 days or less before check-in, the deposit will not be refunded, as it will have been transferred to the villa owner. The remaining balance must be paid in cash upon check-in. In the event that Muses Kalkan cancels a villa reservation for any reason, the customer will be informed as soon as possible. If an equivalent villa is available for the same dates within our portfolio, it will be offered to the customer. If the customer does not approve the alternative villa and the situation does not fall under 'force majeure' conditions, the amount paid will be refunded.
RIGHT OF WITHDRAWAL
According to Article 15(g) of the Distance Contracts Regulation, prepared based on Articles 48 and 84 of the Consumer Protection Law No. 6502, consumers do not have the right to withdraw from contracts related to accommodation, transportation of goods, car rental, catering, and leisure services scheduled for a specific date or period.
CHECK-IN/CHECK-OUT
The check-in time for the villa on the reservation start date is 16:00. The check-out time for all locations is no later than 10:00 AM on the last day of the reservation. To avoid inconvenience, both parties should plan their travel according to these times. If an early departure is required, Muses Kalkan must be informed at least 24 hours in advance. If the villa cannot be inspected due to high occupancy, the damage deposit will be transferred to a bank account provided by the customer, with any transfer fees deducted from the deposit. No refunds will be issued if the customer voluntarily leaves the villa early.
VILLA CAPACITY
Guests exceeding the villa's stated capacity or the number declared at the time of reservation will not be accepted. If the customer wishes to change the number of guests after the reservation is confirmed, they must request approval in writing from Muses Kalkan. If the villa's capacity allows, Muses Kalkan may approve the change and charge an additional fee. After check-in, no additional guests beyond those listed on the reservation form will be permitted in the villa. If this rule is violated, Muses Kalkan reserves the right to request guests to vacate the villa, cancel the reservation, or require the villa to be completely vacated before the end of the rental period.
VILLA MAINTENANCE AND ADDITIONAL COSTS
Weekly villa rental prices include an initial cleaning. For stays of two weeks or more, weekly cleaning and towel/linen changes are included. Any additional cleaning or towel/linen changes requested will be subject to a fee. Routine maintenance of the pool, garden, and other villa fixtures will be carried out by assigned personnel. To ensure these services run smoothly, the customer must allow maintenance personnel to access the villa when necessary.
PETS/SMOKING
Unless otherwise specified, pets are not allowed in our villas. Smoking is strictly prohibited in all indoor areas of our villas.
DAMAGE DEPOSIT
A damage deposit, varying by villa, will be collected from the customer. The deposit amount will be stated in the confirmation document sent during the reservation process. This deposit must be paid in cash upon check-in and will be refunded in cash after a villa inspection upon check-out, provided no damage or loss has occurred. If the customer leaves earlier than the agreed check-out time or the villa inspection cannot be conducted due to high occupancy, the deposit will be transferred to a provided bank account. If damages exceed the deposit amount, the customer will be required to pay the additional costs, and legal action may be taken if necessary.
LIABILITIES AND GUARANTEES
Muses Kalkan is responsible for delivering the villa clean and ready for use on the specified date and time. Any defects or malfunctions must be reported immediately to Muses Kalkan for resolution within 48 hours. Muses Kalkan is not responsible for issues not reported in time. Additionally, Muses Kalkan is not liable for accidents, illnesses, injuries, drownings, deaths, thefts, or other incidents that may occur during the stay. Any problems arising from third-party services (e.g., tours, shopping, food, entertainment, transportation) are also outside Muses Kalkan's responsibility.
FORCE MAJEURE
Muses Kalkan reserves the right to unilaterally terminate the contract in cases of force majeure, including war, riots, strikes, natural disasters, fires, terrorist activities, pandemics, technical issues in transportation, infrastructure projects by authorities, government-imposed restrictions, and other unforeseen and uncontrollable events.
COMPLAINTS
Customers must report any complaints during their stay. Muses Kalkan will investigate and take the necessary measures immediately. Complaints made after checkout will not be considered.
SECURITY AND PRIVACY POLICY
Muses Kalkan will not share personal information with any third parties except as defined in this Privacy Policy and Terms of Use. Muses Kalkan does not sell personal data to third parties. However, information may be used internally for statistical analysis. Customers' personal data will be kept confidential. In the event of a cyberattack compromising personal data, Muses Kalkan bears no responsibility. Any disputes arising from this agreement shall be settled in the Antalya Courts and Enforcement Offices. By making a reservation for any of our villas, customers are deemed to have accepted all the terms above. Any violation of these terms grants Muses Kalkan the right to cancel the reservation unilaterally and deny any refund.
